Theyve found, while some changes may have to be made in office J for inspection beginning March 21. 8 a.m. to 3 p.m. daily except weekends. Another advantage is that the law defines the who, what, when, where and how of collecting and skiptracing. Benefiting both collectors and consumers will be provisions for corrective action against abusive tactics used by a very limited number of collectors who have given the entire industry a bad name. Green says setting up definite channels of communication for the collector and consumer debtor will be especially helpful. Debtors havent known exactly what could or couldnt be done Some have protested our getting their account in the first place. Others felt we werent allowed to call them at work . . . or at home or to contact others . . when attempting to locate them. Some claimed we were threatening them if we mentioned garnishments or lawsuits .and they didnt realize theyd have . . legal fees then, in addition to the original debt, Green said. These procedures, plus many others, are covered in the new law: Debtors may be called an unspecified number of times between 8 a.m. and 9 p.m., unless they tell collectors that other times are more convenient. Green said that calls normally have been made during their daytime office hours, but with 47 percent of women now working - and thus more empty houses during the day - more evening calls are necessary. Debtors may be contacted at their place of employment unless the employer is known to prohibit such contacts. Debtors may be notified will be taken if the debt isnt paid - if the action is legal and actually intended. To comply with one section of the new law, Green is preparing a validation notice to go with the first collection contact. This will help both collector and debtor. It will reveal past due accounts that are in error or that arent actually those of the person being contacted. And, if the account isnt disputed within the 30 day period allowed, it will indicate the debt is valid and the collector can proceed. in Other changes that legal action and printed materials that may have to be made by collection offices checks relate to procedure post-date- d and use of the company or name on an envelope letterhead if the name indicates the company is in he collection business. Green said that his office and others in the American Collectors Association have been studying the new law so that their compliance can be complete.
