He also dismissed a case where a police officer complained of an assault when he entered the home of a citizen without a search warrant. Heres what the judge held: We would advise the police department to secure a supply of copies of the constitution. If they will read it they will probably learn that the 18th amendment is not the whole but that there constitution, are other provisions therein just as important and just as to as necessary the 18th obey amendment, among them the for provision search warrants. "We can see no consistency or excuse for one charged1 with the enforcement of the ri law violating one section of the constitution to ascertain if another sectfon of the same constitution has been violated. "In other words, this court holds no brief for an officer who will break the law in order to apprehend others whom he suspects of violating the law." CITY I am of Egbert The Two notorious bad men were overtaken by the traditional fate of bad men recently; and a comparison of the men and their careers is exceedingly eloquent as a commentary on the trend of American civil- . STREAM Herewith A CONTRAST IN CROOKS ization. One of these men was Jake Fleagle, shot down in a small Missouri town after having been hunted for more than two years for a Colorado bank robbery. Three of Fleagles buddies were hanged for the crime, and Fleagle himself escaped hanging only by dying from the effect of his wound. The other man was Jack Diamond, known as Legs, who was shot down in a New York hotel suite by some of his professional rivals. Diamond had one of the most extensive police records known to man. He had been suspected of too many crimes for any mortal to remember. Fleagle can be said to represent the old type of American bad man; Diamond the new. I'leagles ca- reer typified the career of the Jesse James outlaws; Diamonds was the Dion OBamon-A- l Capone kind. Fleagle was chased all over the country by officers of half a dozen states, aided by U. S. postal inspectors. He was hounded relentlessly by officers whose one idea was to get him and bring him to the gallows. In tjie end he was caught antf killed. Diamond was in a totally different situation. Although his record was long, he feared the police not at all. r His comings and going were recorded in the daily papers. No one could pin anything onf him. Any officer who chased him had to chase discreetly, lest he actually catch him. Diamond was supposed to be the heir of Arnold Rothstein, who ruled New Yorks underworld in a fabulous manner. Rothstein was never bothered by tKepolice, although it was open knowledge that he was a dope peddler, a rum runner, a gunman, a crooked gambler and half a dozen other things. When he was killed the police were positively embarrassed in their investigation of his murder and his passing. Right now they seem to be similarly embarrassed by their investigation of Diamonds shooting. Thus we have an instructive contrast. Fleagle was an outlaw, in the literal sense of the word. He was outside the law. Every mans hand was against him. The police harried him until they caught him. He was of the old type. Diamond, like Rothstein and Capone and scores of other big city alley rats, was not an outlaw at all. He was inside the law. lie had connections. He could laugh at the police. He was of the new type the type that flourishes today in every large American city.
