The Commission having investigated the facts and circumstances and being advised in the premises, now makes this Report containing its Findings and Conclusion together with its Order based thereon. FINDINGS OF FACT 1. The . Utah . State Road Commission is an agency of the State of Utah authorized to and maintain construct, supervise state roads and STATE OF UTAH ss. County organized and existing under and pursuant to the laws of the State of Utah. 3. That the Road Commission and the Union Pacific Railroad have heretofore Company entered into a formal written agreement for the construction of a highway overpass structure No. at Railroad M.P. 40.90 and for the elimination of grade crossing at Railroad M.P. 40.94.' Said agreement outlines and provides for the construction of said overpass structure and the manner in which construction will be accomplished and provisions as to payment therefore between the parties. CONCLUSION The applicants petition is made in conformity with the laws and statutes of the State of Utah, and the matter is within the jurisdiction of this Commission, which concludes that and convenience public necessity would be served by the granting of said petition, provided any interested party be given an opportunity to be heard prior to the effective date of the order. ORDER NOW, THEREFORE, IT IS HEREBY ORDERED, That the petition of the Utah State Raod Commission for authority to construct an overpass structure over the tracks of the railroad at Milepost 40.90 of the Union Pacific Railroad main line from Ogden to Pocatello and the elimination of the grade crossing at Milepost 40.94 of said railroad line, is hereby granted, subject to all of the terms and conditions set forth herein. IT IS FURTHER ORDERED, That the division of costs for said project shall be in accordance with the agreement between Utah State Road Commission and the Union Pacific Railroad Company dated November 15, 1974. About ninety friends and relatives enjoyed roller skating, volley ball and a hamburger fry. Elders from the Bothwell Ward met Saturday at the ball park for an evening of eating, socializing and volley ball. The party was under the direction of Clayton Stokes and Steve Newman. About 25 people were in attendance. All interested people are invited to the ball park in Bothwell on Wednesday and Thursday evening for the soft-bagames.
