The case was taken to the 10th U.S. Circuit Court of Appeals from a federal district court, which ruled in favor of the government. The case involves a stretch of the San Juan from Chinle Creek east to the Colorado 55-mi- le line. The government brought the action to quiet title of the stream bed for the Navajo Indian tribe. The crucial issue is whether the disputed portion 'of the river was navigable when Utah' was admitted to the union on Jan. 4, 1896. If this is the case, title will go to Utah under the constitution.. The middle channel of the river was designated the northern boundary of. the Great Navajo Indian Reservation in 1884. Attorneys for the state sought to prove that the river by settlers and Indians to move goods, supplies and equipment up and downstream circa 1896. Government attorneys contend a stream must be susceptible of being used as a highway .of commerce" before it can, be considered navigable within the meaning of the law. They said steamboats of the. type in use when Utah became a state could not navigate the gan Juan beciuise.of its rapid current, sOt and fluctuating water Jevel. v By JOSEPHINE BAYLES Lila Palmer there will be films on cancer shown at the County Court House in Monti- -, cello, Saturday morning Jan, 13 at 10 a,n.
