Thursday, February 23. 2006 Cedar Fort Fairfield CRIMINAL MISCHIEF - Police took a report of criminal mischief at Cedar Valley Landfill in Fairfield on Feb. 6. The maintenance shed adjacent to the landfill scales was shot repeatedly with a 22-caliber weapon. Officers believe the shooting shoot-ing was done from Allan's Ranch Road because they found 22-caliber shells on the road. TRESPASSING AND WEAPONS OFFENSES - Officers cited three adult men in Manning Canyon for trespassing and weapons offenses while the three were rabbit hunting in the canyon at 10:40 p.m. on Feb. 1 1 . The hunters had gone inside the gate of the canyon, a "no trespassing" trespass-ing" area, and they were operating a spotlight from the vehicle and had loaded weapons in the vehicle. Lehi TRAFFIC OFFENSE - A woman was cited for driving-under-the-influence, driving on a suspended drivers license, open container, and conditional license violation. TRAFFIC ACCIDENT - The driver driv-er involved in a traffic accident was cited for driving on a suspended drivers license and warned on a warrant. A man was booked into the Utah County Jail on a felony warrant. SUICIDE ATTEMPT - A juvenile girl was cited into Youth Court for disorderly conduct. Other offenses included a suicide attempt. Orem HIT AND RUN ACCIDENT - A witness saw a truck slide out of control the night of Feb . 18 at 500 S. State. The truck ran up over the curb and into the business sign at The Planted Ear th. The driver of the truck then quickly left the area. The witness followed the truck and got a license number that he called into the police. Orlando Ruiz spotted the truck traveling northbound on Orem Boulevard and stopped it. The driver, an 18-year-old Hispanic male, admitted to running into the sign. He had a Mexican ID, but no Utah drivers license. He was cited for leaving the serene of an accident and for no drivers license and no insurance. Main American Fork 756-7669 HIT AND RUN ACCIDENT - An Orem ambulance got rear ended by a 17-year-old Provo boy at 1300 S. State just before midnight on Feb. 18. The department paramedics paramed-ics had been responding to a nonemergency non-emergency call and were stopped at the light at that intersection when the youth, who was driving driv-ing too fast for the slippery road conditions, slid into the back of the ambulance. After the collision, the boy kept right on going. He was contacted later at his home in Provo. He said that he'd just gotten his drivers license li-cense and didn't know what he was supposed to do. He got cited for leaving the scene of an accident, and a number of construction tools were stolen. The theft occurred in the area of 1000 N. Geneva Road. BUSINESS BURGLARY - Sometime between Saturday night and Monday morning, someone broke into Zumies at the University Mall by prying an outside entrance. Once inside, the culprit or culprits stole watches, skateboards, and other items. THEFT A microwave oven and dishwasher were stolen from a home under construction sometime some-time then night of Feb. 16 in the area of 400 North 1200 West. THEFT A man arrived at his place of business the morning of Feb. 16, in the area of 1000 N. 1500 W. and found a red 2004 Mazda RX8 sitting up on blocks with the tires and wheels missing. The car had been stolen sometime the night before from the Legacy Ford Dealership on Sandhill Road. ROBBERY SUSPECT CAPTURED CAP-TURED There was a robbery at Sonic, 406 W. 800 North, Feb.15, just before 11 p.m. The suspect, 22-year-old Matthew Lawrence Up-church, Up-church, of Orem, and a former employee em-ployee of the business, entered the business at closing time dressed in a ski mask and black clothing and armed with what turned out to be a soft-pellet handgun. He demanded the day's deposits from the manager man-ager and cook who were still at the business and grabbed the two deposit bags laying on the desk. He then fled in a tan 1999 Toyota Corolla. He also noticed that the driver was wearing dark clothing. He decided the likelihood was good that this was the suspect and decided to follow the car and stop it. When another officer arrived ar-rived to assist, a traffic stop was attempted at 900 W. 800 North, Upchurch refused to stop the car and turned north on 900 West and then east into the Courtland Ridge condominiums. From there, Upchurch drove to 800 West and then back to 800 North, where he proceeded west toward 1-15 at about 50 mph. Upchurch Up-church went southbound on the freeway with two officers behind him at speeds that reached 80 mps and exited I-15 at University Parkway. He went east to Sandhill road and then turned south on Sandhill. From there, Upchurch turned into the Pinnacle Apartment complex at 1400 S. Sandhill Road. While traveling through the parking area, Upchurch decided leave his car and flee on foot. He did so before bringing the car to a complete stop and while it was still in gear. The now driverless car bounced up over a curb and ran into the side of an apartment building, build-ing, doing about $3000 damage to the building. Holdaway pursued Upchurch on foot, yelling commands that he stop. He didn't and the chase continued con-tinued through the complex until Officer Holdaway got close enough to use his Tazer device to stun Upchurch Up-church and take him to the ground. Upchurch continued to struggle and fight with Officer Holdaway until Officer Alan Warenski arrived to assist and Upchurch was handcuffed hand-cuffed and taken into custody. Officers recovered the deposit bags that Upchurch dropped when he was tazed, as well as the ski mask and pellet gun used in the commission of the robbery that he had left in the Toyota Corolla. Upchurch had drugs and paraphernalia parapher-nalia in his pockets when he was arrested. He was booked into the Utah County jail for robbery, drug possession pos-session charges, evading, and other oth-er offenses, including a suspended drivers license. He told officers that he was trying to get the money to leave the state and return to his home in North Carolina. The officer met with the victim and wrote a citation. As the officer was leaving, the suspect assaulted another individual. The suspect was then placed under arrest ar-rest and taken to the Utah County Jail. VEHICLE BURGLARY - A IBM think pad, a black bag, a OGIO Gym bag, a MP3 Player l-Pod, a Blackbury cell phone, and other items were reported stolen from a vehicle at a residence. RESIDENTIAL BURGLARY Cash, prescribed Clonazapam pills, and prescribed Oxycodone pills were reported stolen from a residence. CRIMINAL MISCHIEF - Officers took reports of windows being broken out of 24 vehicles in different differ-ent parts of the city. These were reported on Feb. 14. CRIMINAL MISCHIEF - Two individuals reported that the front windows of their residences were shot by a BB-gun by an unknown individual. CONTROLLED SUBSTANCE PROBLEM A man was arrested for possession of methamphet-amine, methamphet-amine, trespassing, and possession posses-sion of paraphernalia after officers responded to a report of a suspicious suspi-cious man. CONTROLLED SUBSTANCE PROBLEM - While on patrol, officers stopped and conducted a field interview with a man to find out how old he was since he was smoking a cigarette. Dispatch advised ad-vised the man had recently turned 19 and he had an active warrant. The man was taken into custody and marijuana and paraphernalia were found into his pocket. He was booked into the Utah County Jail on drug charges, but the warrant was from Salt Lake County. The originating agency did not respond to pick him up, so he was advised only. TRESPASSING - Three arrests were made for trespassing after an officer investigated a truck that was driving in the foothills. THEFT Police responded to the location on a report of a theft of a black Jeep Laredo bicycle valued at $500. He pleaded guilty in November No-vember to two felony counts of attempted forcible sexual abase. "I've adopted a one-year sentence sen-tence instead of 60 days because the victim was very vulnerable and somewhat naive and he was a registered sex offender," said Judge Lynn W. Davis. In making his decision, the judge said Wilkins, who is deaf, held a prominent position of trust in the deaf community as a college American Sign Language Lan-guage instructor and violated that faith when he abused the female student. Not only was the student victimized, he said, but aLso her mother, Wilkins's wife and children, the deaf community com-munity and the community at large. Davis was appalled that Salt Lake Community College and Utah Valley State Gillege had employed a registered sex offender. of-fender. "That is beyond the belief of this court," he said. Wilkins will aLso have to pay a yet -to-be-determined amount of restitution restitu-tion to the victim and her family for counseling expenses. The judge authorized AP&P to monitor Wilkins's Internet and computer use and ordered him to successfully complete sex offender treatment and to register with the state as a felony fel-ony sex offender. I le has been listed on the Utah Sex Offender Registry since a felony conviction convic-tion on two counts of lewdness with a child in a 19!).'i case. Davis restricted Wilkins from accessing any pornographic media saying that it was his impression that a pornography addiction was "the genesis" of the convict's sexual crimes in the case. Overcome with emotion, Wilkins spoke briefly expressing express-ing remorse to the victim and to all those he had hurt. "I've been considering the wrongs I've done and I accept full responsibility." he said though an ASL interpreter. "I ask for forgiveness ... and want to never repeat this act." After the hearing, the victim said she was pleased Wilkins got a year in jail, but wished he had gotten more time behind bars. m h1.
