Those problems went way once the Ashtons were evacuated from their home. Mitchell and Tami Hansen also have a lawsuit. Their sons Sam and Jake suffered from consistent, severe headaches last summer and fall. Sam passed out one day in October and was hospitalized. Doctors ran tests to see if perhaps he had a brain tumor. Daughter Cassie began requiring steroids as treatment for severe asthma, the cause of which doctors could not determine. Another lawsuit comes from Frank Pike, who tried to refinance his house with a shorter-term loan at a lower interest rate. He was denied. He then tried to sell it. Realtors wouldn’t even list the property—environmental damage had devalued it to the point of near worthlessness. Plaintiffs are suing for outof-pocket cleanup costs, displacement and loss-of-income, property damage and devaluation, past and current health problems and potential future medical conditions. By the time all those things are factored in for each plaintiff, the cost of the gas leak to Wind River could end up in the tens of millions of dollars, depending on what trial juries say. And that doesn’t even count the cost of cleanup itself. Those costs could end up being nearly $3 million, with Wind River paying two-thirds of that. The first $1 million was paid by a special state fund reserved for such things. Wind River is responsible for anything beyond that. “The state spent their million bucks,” Wind River President Craig Larson said last week. Since then, “We are probably in the neighborhood of another $600,000 that we have spent.” But now that cleanup systems are in place and just need to be maintained, “Those costs should drop off dramatically,” Larson said. According to Wind River’s environmental engineers, Larson said, the price tag on the cleanup should drop to roughly $10,000 per month. With a cleanup duration of possibly 10 years, that could add another $1 million to the total remediation project, brining it to almost $3 million. Yet just as costs continue to increase, so, too, do “the results continue to go up,” Larson said. He said that a couple of systems near the Top Stop lot where the leak began are already picking up less fuel, indicating that the cleanup effort is succeeding. “The important thing is we’re continually putting in the money to get the thing cleaned up, and the numbers are showing that,” he said. Larson has another reason to be positive. Last month, the Utah Attorney General’s Office closed its second investigation into whether Wind River knew about the leak and tried to cover it up. The AG’s Office first looked into the matter last fall with the same result, but re-opened the investigation last winter because of persistent rumors of wrongdoing. Spokesman Paul Murphy said he was notified on May 12 that the case, for the second time, had been closed. “They did not find any additional information that would warrant any criminal charges,” Murphy said.
