Lake stake with unlawful un-lawful cobabitatlon The specific Instance In-stance named was President Cannons alleged cohabitation with Mrs Martha IlughesCannon Salt Lake member of the Utah state Renate A warrant was Issued yesterday nftenlOon and served upon President Cannon by Deputy Sheriff Cummock Bonds were given In the sum of 300 by Bishop Hber Bennion and Barlow Ferguson for PreFident Cannon who aPijeartd before Justice Pardee IIp was represented by Ferguson Cannon 7 Can-non and the trial was setfor July H Who Owen Is Charles M Owen the author of the affidavit is a Welshman the younger son of a wealthy father who It is alleged al-leged cut him off without a shilling He came to Utah several Years ao and for a time practiced Ws professIon that of civil engineer but has recently ben engaged in working up anti Ior mon sensations for the New York Journal It is also reported that he has been asistin thE local antiMor mm newspaper in i collecting storm Rtarting material and that he supplied It with the alleged data Upon which it based its libelous charge that a majority jorit of the prominent citizens of fpanlsh Fork were guilt of unlawful cohabitation He is regarded by many as somewhat erratic and an antiIor mon fanatic ThE story concerning the prosecution of Angus M Cannon waR wired by Owen to the New York Journal twenty four hours before he appeared before the ounty attorney with his affidavit and was aho given in advance to the local anti1onnon paper The facts in thE case seEm to Indicate that he Is I acting in Ws capacity of a pUreYlll of sensations to yellow journalism rather than as a citizen desiring an en torNment of the law A Possible lIIotive Angus 1 Cannons arrest it is charged i charg-ed it but another feature of the New York Journals undertaking to ouSt Congressman Roberts and regulate soda so-da conditions In Utah It Is understood under-stood that a number of other cases hay been worked up by Owens at the yellow journals expense The arrests One observer yesterday also noted a somewhat close connection between be-tween this programme and Colonel Lan nans antirormon newspaper and all Gentile Dolltical party It is understood to hethe Hearst pro t gramme to defer the hrrest of Con grossman Roberts until just prIor to I the meeting of congress in order that the case may be pending against him when the question of his eligibility comes up for consideration Among the prosecutions it 5 said will be one for the offense or polygamy Owens Affidavit During the morning Owell appeared J before County Attorney Putnam and showed an affidavit which he had made out and signed before Notary E V Taylor Ir Putnam looked over the matter carefully and made an appointment ap-pointment with Mr Owen for i oclock in the afternoon At that time there was further discussion of the subject and Mr Putnam with the hfIhlavlt which Mr Owen presented as a basis nade out a complaint charging Mr Cannon with unlawful cohabitation Mr Owen declares that he can prove his case said Mr Putnam and he has presented an affidavit making very oz specific charges so that there was nothIng for me to do but to make out si f b = r a complaint and see that a warrant was issued The affidavit which Mr Owen presented pre-sented to the county attorney Is as follows State of Utah County of Salt Lake s s C M Owen being ltrt duly sworn de poses and says That he is a citizen of the United States and a resident and taxpayer tax-payer of the city and county of Salt Lake That he Is informed and veriiy I believes that 011 or about the 15th day of April 1t9 one Martha P Hughes Cannon state senator of the legislature of Utah was delivered of an illegitimate child That the aforesaid Martha P Hughes Cannon Is by common habit and repute In the i community the plural wlfo of AnUs M Cannon president of the Salt Lake stake of the Church of Jesus Christ of Latter day Saints and the aforesaid Angus 11 Cannon Is the father or the said child contrary to the provisions 8th day of July 1899E E W TAYLOR NotaryPublic When the complaint was sent to Jus tlce Pardee he issued a warrant and It I was placed ill Sheriff Howells han for service The sheriff telephone to MrCannon that he had the warrant and Mr Cannon replied that he would go to Justice Pardees office at once with his attorneys and bondsmen The warrant was given to Deputy Sheriff Cummock and he met the attorneys at the justice court but Mr Cannon was not present Bonds Given At 5 oclock Mr Cannon through his attorneys Barlow Ferguson and John M Cannon entered his appedrance and gave bond in the sum of 300 Repre sentatle Heber Bennion of Tayiors yule and Attorney Ferguson sIgned the bond Justice Pardee fixed Friday July H as the date for the trial As thechare is a misdemeanor Under un-der the statutes Justice Pardee has original jurisdiction It Is within his power to acquit Mr Cannon or if he Is proven guilty to assess II fine of not to exceed 300 or a jail sentence of not to exceed six month or both Attorney Ferguson declined to give any Idea of the line of defense that will be adopted Aslr me something easy he aid laughingly when pressed for an answer Owens Statement This case simply means that I have take up the defiance of the Deseret News and church leaders who maintain that polygamy is a thing of the past I said Mr Owen There is no one behind i be-hind me In this prosecution no one at all The case is not instigated by any newspaper nor am organization opposed op-posed to Mr Roberts or polygamy I alone am responsible for it I am not working with any of the ministers of Salt Lake But the Deseret News has sal < lthat there IR no such thing as polygamy and President Snow delivered an address ad-dress some weeks ago In which he said that Iiolygrm was forbidden I am going tl show that It is not forbidden for-bidden and I have plenty of proof to show that Mrs HuhesCannon is a plural wife of President Cannon Why the matter is of common knowledge I will not at this time say whether or not I shan commence other prosecutions prosecu-tions nor will 1 tell the direct evidence which I have in this case A child was born to Mrs HughesCannon and the matter Is of record with the board of health President Angus M Cannon Is given as Us father but I have more evidence of the polygamous relations sustained I am not dependent upon this record alonE We have laws I against polygamy and they ought to be enforced Exhibited the Baby Mrs HughesCannon when seen last night declared that she had absolutely nothing to say about the arrest of her husband I dQ not know what will be done and I cannot say anything except that I hope the matter will xow be settled for all time Although refusing to talk of the trouble that has overtaken her she delightedly de-lightedly exhibited the 10 weeks old baby which as she says has raised all the rumpus And the mother as she dangled the small bundle Insisted that she must not orry over the result re-sult of the aew fight because she had to get strong and well to take her baby r i b I away from the hot weather and the city President Cannon was seen but declined de-clined to make any statement concerning concern-ing the case This Is not the first time that President Presi-dent Cannon has been in trouble on the same charge He was convicted of unlawful cohabitation with Mrs Martha Mar-tha HughesCannon
