of william smith who keeps a saloon on second south street for selling aquor without license was before justice clinton today to day the charge was waa fully sustained and mr smith was filled fined loo the defend defendants anes anCs counsel mr R M H Robert Bo bertson robertson son sod informed the court that he desired to give notice of an appeal to a higher court the justice stated that thattie the chief justice of the territory had bad ruled that there was no appeal from his mr cliftons Clin tons court and a although he mr clinton differed from this view ot of the matter he was notwithstanding bound to respect the rulings ot or 3 adge mckeand Mc Keans court as it was a superior cou court rt or court ot of review mr robertson said cases could ce certainly r be appealed from the justices court justice ailt clauton on said he also thought the law provided for such buch appeals but a higher court had ruled differently and he intended to adhere to such ruling toe tor however robbery 79 and who was wab yesterday forenoon set at libe ilbe liberty t on n a writ of habeas corpus by judge C M hawley was wax arrested last night for shooting his pistol off in the national saloon the ball lodging in the ceiling and for doing the same thing in smiths saloon the latter time the ball passed through the door and hit bit john shultz who was standing on the street just outside la in the left elbow and passed out t about three or four inches below the joint I 1 inflicting a very severe flesh wound the charges against dunn were fully sus talked by evidence this morning and justice summer and aud the succeeding winter in washington endeavoring to carry futo luto effect the wishes of or the people of the territory in regard to admission in 1865 he be was again elected as delegate from the territory to con press and has been elected three times delegate since that time making in all ten years service as Da delegate legate to congress and the greater part of two years as united states senator elect from the em state previous to the nomination of delegate last year he notified his friends that he did not wish to be a candidate for or their suc suf frages suffrage sl as he
