I'FlteONAL The attendance at the Clawson bigamy trial this morning was as great as yesterday, the court room being racket! and every available srace occupied. Tbe two absent jurors tor whom attachments were issued yesterduy were nut produced, one of them being sick and ibo oificei rent to serve the other nut having re turned. S. C. Variau, on behalf of tbe prosecution then stated that tiie regular venire was exhausted and no more names re uiained in the bux from which to draw a special venire. He therefore moved that an njran venire lie ordered by the court to complete the panel, as hut ten jurors had been secnreJ Defendants made no argument against the issuing of such an order, but would ihject to an oirau venire. Tiie United States insrshul was then ordered to summon six juror under an 0en venire and a recess of twenty uiinutei wa taken while these jurors were being summoned. O. Yah Trott was the first juror called under the open venire, and he, with J. J . Farrell, the latter being the only re maining juror of the regular venire, were then examined as to their statutory qualifications. It was found that Yon Trott had not been a resident of the district the length of time required by the statues, nnd he wan challenged nnd excuied. Farrell possessed the statutory qualifications. O. M. Palmer was then called and was isllenged by the defense, upon admitting that he had formed and expressed an opinion in the case. The challenge was sustained. J. J. F'arrell was then questioned under tbe Edmunds act as to hw belief in the practice of polygamy. He answered the questions m the negative and was passed by the prosecution. The defense then exercised the first of their peremptory challenges by challenging Farrell, and he was cxcusmI. Ellsworth Daggett and J. C. Conklin, both summoned under the open venire, were called next. J. C. Conklin was not present, and Edmund Wilkes was called. These jurors both possessed the statutory qualifications ami neither believed it right to have more than one living and nndivrrced wife at the same time. This completed the panel, and the defense peremptorilv challenged Chan. Gilmore, who was sworn yesterday. The prosecution denied the right of the defense to exercise their peremptory righto on jurors who had been sworn, anil tliis position was sustained liy the ruling of the court, to which defense took exceptions. The defense then challenged the whole panel on the ground that the names of Daggett and NVilkes had nut been drawn in the manner prescribed by law blit by open venire, l'lie prosecution denied the challenge and the' denial was sustained by the court. The defense next challenged Daggett and Wilkes on the same ground and this challenge was also denied. Daggett and Wilkes were then sworn and the panel was completed. The following are the names of the jurors secured : E. NV. Loder, Thoe.Sappiugton, M. NY. Davis, G. M. Forbes, D. C. Booth, Geo. NV. Richmond, Chsrles Gilmore, J. F. Woodman, NYrn. Husbands, D. NY. Scribner, Ffilsworth Daggett, Fsltnund Wilkes. Attorney Dickson asked that the witnesses in the case be excluded from the court room while the testimony was being taken, which was granted and the names of the witnesses for the prosecution were called, not more than half of them being present. Among those called who failed to answer to their names were John Taylor, first president of the C. of J. C. of L. D. S., and his two counselors, George (j. Cannon ami Joseph F Smith. Judge Harkness stated that the defense had no witnesses and did not know that they should summon sny. The prelinunarv work now being dis poed of, the taking of testimony was commenced. The first witness for the prosecution was ALICE DIXWOODT, Who testified as follows : I live in Salt Lake City ; am acquainted with Rudger Clawson, the in this case ; have a sister named Florence; have known defendant about three years, and 1 believe my sister Florence is his wife; they were married on the 12tli day of August 1882; 1 waf not present at the ceremony, but attended a reception thnt evening at my father1 house ; defendant and my sister were both present ; I do not remember that he ini induced tuy sister as his wife; defend sill and my sister lived at my fathers house as man and wife for six or seven months and then moved to a house en North Temple street in the Eighteenth ward ; defendant is now living at H. B. "lawsons house; left hi home in the ugh teen th ward almnt six weeks ago; two nr three time visited my between last December and May ; there were no ether members of the family except niy sister, her husband and child ; they employed no servant ; I met several people there ; I know Lydia Spencer; have not known her many inontlis; 1 knew her last January ; I met her first at defendant's boose in the Eighteenth want the latter rt of last year. the defense The counsel for here objected to the question as to whether witness hod been introduced to Lydia Clawson at defendant's house, stating that such evidence was introduced for the purKSW of shnwins1, by defendant's admission, a polygamous marriage. This class of evidence was competent in proving the first marriage, but not in proring a second. Attorney Dickson stated that his attention had just been called to the fact that the indictment hod not yet been rend to the jurv, 'and suggested lint it now be read, which was dime.
