foreclose For close tax lien Lierl washington april 15 the right of a county to foreclose a tax lien on general property taxes on real property was clearly established by reason of a decision handed banded down by the supreme court of the united states at washington agton last week in the ithe case of carl W jones et al vs box elder county et al theretofore appealed to the highest tribunal from the circuit court of appeals of the ithe tenth circuit the action was originally commenced by the property owner who being a resident of 0 the state of new york tiled filed an action in the federal court of utah to quiet tit title leto to his bis property alleging that by reason ot of certain mistakes on the part ot of the assessor and treasurer as to lo the manner ot of assessment and publication the taxes during the years in question were invalid the county joined issue by setting up the tax lien foreclosure abot as passed by the 1927 legislature and thereafter trial was had which resulted in a decree ot of foreclosure in favor bavar ot of the county la in a sum exceeding appeal was had to the circuit court ot of appeals where the case was waa argued over a year ago and thereafter a decree was made su sustaining 9 tire the validity of 0 tax system now the denial of a writ of certiorari by the supreme court establishes once and for all the right ot of a municipality to proceed to foreclose its tax lien county attorney lewis jones ot of brigham city who conducted this long litigation in behalf of 0 the county states ethere Is no renson reason why each county should not now proceed to foreclose its liens in aggravated tax cases by this procedure anu whereby the county places itself in a position to give I 1 a first class title to a given purchaser as against the questionable titles that is now purchased with the ordinary tax deed since this decision box elder county has filed an additional suit under this statute and is preparing to tile file others as soon as the necessary notice can be served on the former owners it is expected that considerable property will be put back on the tax lax rolls in the state and ed revenues will be received by the several taxing units through ii put out tb the state providing other counties follow this procedure RIOT MOT JUNE 45 4 5 many good ball games played sun sundays league results bluebell won from
