Editor, ; The Milton homicide lias given the District Courts of Utuh an occasion to show their determination to prohibit t he Probate Courts from exercising the jurisdiction in criminal caseii which they have held undisputably for twenty years, and legally, according to the Territorial Statutes. On the 20th of August, John Olaen was brought before Justice John II. Gili'l for examination, and as lie pleud-o- d guilty to the charge of shooting T. J. Thurston Jr., he was committed foi trial before the Probate Court. This is how it used to be before the deciniotw) of the immaculate Judges. The Probate Court, learning by advices from Z. Snow, Attorney General of the Territory, that they had no jurisdiction to try the cane, sent the prisoner back to the Justice of the Peace. The Council for the defence filed a motion for further examination of witnesses, to prove what witncBHPR it would be necessary to send to the District Court, and thus prevent any delay in the trial before suid Court. j The motion being granted, on the HHth ult, a further examination took place. for trial The prisoner was before tho next term of the District Court, and the Sheriff was ordered to deliver the prisoner into the hands of the lerntornil Marshal. During the examination on the 29th ult, an intelligent "New Move" convert, mistaking the examination for a trial by jury, telegraphed to Judge Hawley that the Probate Court was going to try the case of the People vs. Jol)n Olsen. The author of the telegram, on finding out his mistake, confessed what he had done, to tho Probate Judge, nnd promised to go and contradict the telegram, but not having four dollars more to spare on the telegraph, proceeded to write a letter to set the mutter right, liut the Judges being so anxious to prevent the Probate Court from doing wrong, could not await the arrival of the letter correcting tho mistake, but took inimcdi-at- o steps to have the prisoner taken from the Probate Court and brought before Judge Strickland. On Tuesday morning, the United States Deputy Marshal arrived at Morgan City by the nine o'clock train, armed and equipped with a warrant from Judge Strickland for the arrest of tho prisoner, to take "him before Judge Strickland at Salt Lake City for exam, iuaiion, and although the Marshal was made acquainted with the examination before the Justice of the Peace, and the prisoner sent to the District Court for trial, as if ignoring the jurisdiction of the Justice of the Peace to examine the prisoner, he proceeded to subpoena witnesses to appear at the District Court at Sail Lake City, on the 1st of September at 10 o'clock a.m., for the examination of the prisoner. About two hours before the arrival of the Deputy Marshal,' our Sheriff had started out for Salt Lake City with his team, taking the prisoner to the Territorial Marshal; so the U. S. Marshal had to return, disappointed of his game. About three months previous to this flair, we had an insane person going about with a revolver, threatening the lives of our citizens. An ci der was issued by tho Justice of the Peace of Mor-gaCity to the Sheriff, to take the pistol from this lunatic. The Sheriff found it necessary to take some assistance to carry out the order, for the lunatic, on learning that the Sheriff was after him, retreated to the top of a lime kiln, and there under the cover of Buch a fortification, with revolver drawn, defied the approach of the Shcriffand his assistance. Ttie Sheriff, determined to carry out tho order of the court, took the pistol, but in doing so, one of the assistants wounded the lunatic Immediately after, tome of our transient friends to the United States Marshal to come up and arrest the man for shooting the lunatio. The next morning the United States to take into Deputy;' Marshal-arrivecustody the Deputy Sheriff. The Marshal demanded a warrant for tho arrest ofthomau to take him to Salt Lake City. The Justico, however, feeling himself bound to bo governed by the Territorial Statutes, issued a warrant to. the Const able, nnd had the Deputy Sheriff brought before him,, and on examining the case, found the defendant innocent of any crime, discharged him, and tho complainant paid the costs of the court, and sought the forgiveness of the defcudant, to prevent a suit for taking a false oath. The Marshal, on learning the facts of the case, felt that the authorities had done all right, re turned noino, ana reported toe tacts as they were. The above shows unmistakeably the avidity with which the Judiciary sent into our midst, seize hold of every op portunitv jo show their mistrust of the local Judiciary, and how anxious it is to make Itself the" legal power or the Territory, why do not these Judges, on receipt of such false telegrams, seek information of the local authorities, and know they are right before they actT The reason is obvi cub, it shows the animus they have against our people, and according to my judgment, it disqualifies them to sit in the Judgment seat, for who can be per suaded that such men will do justice to tho people! We do not profess to know all the outs and ins of the law; we are willing to be corrected, when we see a desire on the part of our teachers to do us good, and will not willingly do wrong, but when we see a determination to take every advautago of our iuexperienee, and such manifest distrust in our honesty. we feel like contending for our rights until such characters shall no longer fill such responsible positions. They ad the small pox but ha did not know it, he thus became exposed, and the disease has since broken out. He has been removed and the most stringent measures have been adopted in order to prevent the spread of the fearful malady. The patient is doing as well as con be expected. There has been considerable sickness here of late, but as a general thing the people are enjoying good health.
