Motion for reconsideration of the state supreme court's recent ji ruling for dismissal of the I ogan ) city suit against the Utah Power it Light company seeking to establish Logan city's right to fluctuate the waters of Logan river for city power plant purposes will be filed soon. City Attorney Leon Fonnesbeck gave this intimation Tuesday morning in discussing the decision of the supreme court dismissing Logan city's suit. The supreme court was merely by its action upholding the decision of the first district court which ruled sometime ago that Logan city had failed at the proper time some years ago to file on its asserted rights to fluctuate the waters of Logan river. In the lower court, the Utah Power & Light company had filed suit against users of waters of or tributary to Bear river in Cache valley, and Logan city by reason of operation of the city power plant in Logan canyon became one of the defendants. Logan city had entered into a stipulation with the power commade no pany. The stipulation mention of lA)gan city as a defendant, nothwithstanding Logan had operated its own power plant in Logan canyon since 1904. The adjudication of the suit came about in 1922. In 1928, the Logan, H; Je Park and Smithfield canal company filed suit against Logar. cLy seeking to enjoin the city ftom fluctuation of the river waters. The in hav.ng the power company brought into the action and asserted Logan's power right contentions. City counsel argued that Logan had a right to hold and release water from the river in its reservoir for power purposes. The Utah Power A Light jeompany, as well as the individual (plaintiffs against the city, succeeded in having the district court reaffirm its 19.12 ruling that Logan has no right to fluctuate the natural flow of the liver waters. The municipal power plant is located above the Utah Power & Light property in the innvoii thus enjoining the city from fluctuating the water. W hen the city officials carried the 1928 decision on appeal to the supreme court, the higher court sustained the uemur-e- r filed by the power company. As a defense move.
