Raymond, the widely known mining expert, aenda the Engineering and Mining Journal of New York a in very interesting communication which he diacuaeea the action of the Colorado Mine Operators association, in seeking to have changed the rule of the department of the interior that, in mineral patents, the calls in the patent constitute the survey and not the that is to say, as acta of the ground the writer puts it, "that courses and distances, stated in a United States shall take precedence of patent, monuments on the ground, as determofining the acta of the general land of later patits grants in fice limiting A quadruple execution will your sleeping room, if furnished with one of exquisite Golden Elm, Rotary Ash, Birdseye Maple, Oak or Ma Will be I 'i 0 FROM $20.00 TO $1 10.00 take place at the state penitentiary at Car-so- n, City, Nev.. early in January. The four murderers are named Fred Rob- erts, Frank Williams, J. P. Seveuner and J. P. Gorman, and were convicted at Winnemuccu a short time since of the murder of a young nmn named Robert Welch, committed near that place last August. The convicted men form part of the murderous gang of s apd murderers which has been operating along the line of the Central Pacific, between Ogden and Reno since the railroad construction work commenced about two years ago. Their crime was a particularly atrocious one, they having beaten and robbed young Welch, who was a laboring man whom they found riding on a freight train. After robbing hint they threw him from the moving train, firing two shots into his body as it Lay upon the ground. Welch lived long enough to identify the men who had committed the dastardly deed, they having very fortunately been arrested a short time after committing the crime and near the Prices hogany Bedroom Suits. Continuing he says: It is declared that the courts have followed the latter principle; and indeed, I do not see how they could do otherwise, since It i a well known part of the common law, governing deeds of real estate, and, moreover, founded in reason and equity. Any ruling of the department of the interior contravening the decisions of the courts is merely "department laws, and must yield at once to the higher authority of Judicial decisions. On the case as stated by the Colorado M'ne Operators asociation, I do not see how they could by either doubt or difficulty connected with the forcing of the general land office to confirm Its practice with the. decisions of the courts, by which its grantees will, of course, be ultimately bound. There Is, however, another view of the case, concerning which I do not feel so sure. The general land office has to conduct its business under our curiously absurd mining law with much much difficulty. There are po maps in existence (and according to the United States statutes, there can be none) showing that portions of the public domain have been appropriated loby private claimants. For "mere cation, not recorded in the United States land office, confers at once a possessing title, of which the United States receives no notice whatever, until the possessory owner desires to buy the land outright and receive a patent therefor.
