the schools instead if a group of school officials have their way It was revealed Thursday The whole thing seems to hinge on the attorney general’s office where an opinion is now being written at the request of the state school office pn the legality of a transaction which would plump the entire fund into the laps of the school people No intimation has come from the attorney general’s office as to what the opinion might be but it was learned that the state auditor's office will fight the proposed transaction even if it means going to the state supreme court The auditor’s office believes the proposal would enrich the schools at the expense of the general property taxpayers Push Proposal The proposal which involves a series of complicated transactions was first proposed early in the spring in a resolution adopted at a meeting of the Utah State School Boards’ association It is understood that the chief motive power pushing the proposal has come from the livelier and Provo school boards PursuantHO the demands made by the resolution Charles H Skidmore state superintendent of public instruction asked the attorney general for an opinion on the legal aspects of the problem This year the state has been recelv- ing considerably larger sums of money through redemption of property taken Joseph Ches for delinquent property taxes This money has been allocated to the various state funds and of course the state district school fund has received a large share of it It has been counted on to help bring the school fund up to the legal maximum 6f $25 per school child The school board association proposes that the schools’ share of the money be placed back to the credit of the district school fund in the years in which the taxes it represents were levied In those years due to depressed business conditions the school fund did not reach the $25 per school child Pay From Excess If this were done it would mean that a large sum would be taken away from this year’s district school fund and it would have to be made up from the $800000 in excess sales tax money Then of course ‘the sales tax money could not be used to help reduce the property tax levy The attorney general has been asked to decide whether the redemption money can be applied retroactivly so to speak to deficient district schooL funds of past years or whether it must be applied to this year’s fund Up to sion and when assessment figures were reported this year it was fqund that improvements had increased more than any of the four classes of property valued by the local officials Mr Arnovitz said after receiving the governor's letter that the request would be complied with and an effort made to determine If improvements have been given too great a share of the tax burden He said that Salt Lake county is one of those in which the revaluation program la being carried out If it is found that a reduction is ustified Mr Arnovitz said it would be a blanket reduction to all counties in which the revaluation has been conducted The work of revaluation was undertaken with the idea of eliminating inequalities in individual assessments not to bring about a general increase the fiscal year totaled $260606117 By the end of the fiscal year on June 30 it is estimated that approximately $2800000 will have been collected The law provides that the first $2000000 of shall go for relief purposes This ‘amount already has been set aside for the state department of public welfare The law provides that all in excess of this amount shall go to make up deficiencies in the state district school fund and the state equalization fund This means that if the crediting back of the redemption money should leave an $800000 hole all the excess sales tax money would have to be poured Into it At any rate whatever the deficiency might be sales tax money would have to be used in making it up Use of Funds Under the law if there is no deficiency in the school funds the excess is made use of as follows: The first $300000'Ts placed to the credit of the governor for budget balancing purposes the excess above that is used to apply on a reduction in the district school fund property tax levy If the attorney general turns thumbs down on the proposal of the school boards' association here is what will happen to the excess: Somewhere between $50000 and $100000 will be used to make up a deficiency
