Dickinson was held for general sessions by Justice Wyatt on a charge of violating section 72 of the Penal Code, which makes it a felony for any public officer to "ask, receive or agree to receive a bribe, or any money, property or value of any kind, or any promise or agreement therefor, upon any agreement or understanding that hls vote, opinion. Judgment, action, decision or other official proceeding shall be influenced thereby. The crime is punishable by not more than ten years Imprisonment or a .fine of not more than $5,000 or both. Conviction also entails the forfeiture of the office and disqualification from holding public office again. Dickinson gave bail and then sued out a writ of habeas corpus, alleging that no crime had been committed, as no money or its equivalent was to have passed in return for the agreement to vote. He also offered a leter written to him by Dr. Woodbury ten days before hls offer, in which the commissioner said that if the proposed appropriation passed the board of aldermen he would need more drivers and might reconsider Covlno's case In its regular order. Dickinson's writ was dismissed at special term and he appealed. , -- FOR SALE! Nice six-roo- m house, busiFOR SALE A ness, paying $3,000 per year; everything complete; at a great sacrifice.
