Show The National Enterprise, April 6, 1977 Page sixteen KCC objects to double standard Since EPA refusal last week to hear Kennecott Copper Corp. plead for an extension in meeting federal ambient air standards, the case is locked in stalemate. In heated arguments neither KCC nor EPA could come to agreement on the legality of Kennecott building a single contact acid plant, since while the plant satisfies the standemission federal ards, EPA believes the copper smelting plant needs a double contact acid plant. According to A1 Rickers, Utah air quality chief, the question stems from action taken by the Utah Air Conservation Committee in 1972 when it submitted a proposal to the EPA for sulpur dioxide emissions. EPA rejected the proposal. By law the agency then had four months to promulgate an alternative plan, which they did. However, in 1975, the Utah committee issued a revised implementation plan. Rickers said the plan, to date, has not been rejected by EPA, but added he has heard rumors the plan may not be approved. Rickers said the new plan would supercede the EPA plan. Meanwhile Kennecott, laboring under the states implementation plan, asked for and was granted a variance in visual emission standards, and consequently proceeded to build a single contact acid plant. Vern Hooser, a spokesman for KCC, explained the single contact plant passes QKKlSo o dioxide gases sulphur solua neutralizing through tion once; a double contact plant repeats the process. While being more costly, the double contact plant does not increase air quality, Hooser said. Burdened by its own complexity, the double contact plant is hindered by additional downtime and maintenance that may actually lessen the systems efficiency, he said. The double contact plant would cost KCC an additional $6 million. EPA countered that since Kennecott is not installing the new equipment deemed necessary by EPA, their request to extend the compliance schedule is irrelevant. Kennecotts counsel requested the Utah Air Conservation Committee to file legal action against EPA demanding that they approve the states implementation plan.
