Show THE MIDWAY MURDER. We learn from our Salt Lake exchanges that some days ago a man named Davis, at Midway, Wasatch Co. beat his son, a young man, over the head, which it is supposed, caused his death. He was arrested, and after a preliminary examination, taken to Provo. This was about the time the grand jury of the First District Court was discharged. On Thursday morning an examination began before U. S. Commissioner Owen Smoot and was still in progress yesterday afternoon. Thurman & Evans were prosecuting attorneys and A. G. Sutherland appeared for the defendant. The main witness aside from the medical men is a brother of the deceased about seventeen years old. He testifies that on the evening of the quarrel and when the beating took place that he the witness was in the house but went out while the quarrel was in progress, and afterwards on returning he found his brother sitting or partly lying with his head against a rock wall on the outside of the house and he noticed some blood on his brother's head. He spoke to his brother, who replied with one word. This answer was ?? out in the evidence. The witness tells of seeing the scuffling as he was going away from the house. Another witness who saw the post mortem testified as to there being clotted blood at the base of the skull on the left side, and as to the nature of the wound, Dr. McFall, who made the post mortem was not present, and the court called on Dr. Pike to give evidence, and in substance he corroborated the evidence of Dr. McFall before the examining magistrate. In the testimony it came out that young Davis was at a dance the night before he died, and that he lived about fourteen days after the quarrel and scuffle with his father. After the evidence was in, when our informant left arguments were about to be made upon a motion to dismiss the case. |
