Don Ostler, from Department of Water Quality, explained that language in Statement of Basis for lagoons: "The lagoon treatment technology has also been analyzed for its potential to control excessive odors. " simply means that the sizing of the lagoon is based on an organic loading rate formula. He said his department has no legal authority to impose odor control measures on the lagoons. Odor control can only be instigated and enforced by the local Planning & Zoning Board and the Beaver County Commissioners. Permit 94-- 3 was issued with no odor control conditions. Permit 95-- 4 added as a condition that the company would add a summary sheet of water tests from monitoring wells, DWQ annual report and out of compliance data nothing about odor. Permit 95-1- 0 specifics that the entire operation located in Beaver County may be monitored for negative impact, including odor. The planning commission can write a letter to Circle 4 notifying them. Circle 4 is then required to provide a written response and show a reasonable effort to mitigate the problem. Same condiUon applies for Permit 96--5. Conditions attached to the boarstud facility are basically the same according to Cindy Peterson, P&Z secretary. With the greater concentration of hogs, failure to put some teeth into the permits will most certainly add to an already growing problem. It must be addressed at the local level. Residents have contacted board members and at least one Milford City Council member concerning odor, but say they are unwilling to publicly voice an opinion because they are afraid of social or fiscal retaliation. Mandcrfield residents are a little more vocal they say they don't want to smell pigs at all period. The voice of the people can 't be heard unless they speak!
