A caucus of Democrats, around w hicb much secrecy was thrown, was held yesterday yes-terday after adjournment. It was rumored ru-mored thai the yuestion was discussed in caucus and a plan ot action agreed upon. But no Democratic member last niu'ht would divulye what was considered at lh caucus and particularly avoided any intimation inti-mation even that Die eligibility fight had been taken up or acted upon. He. however, mere- j ly brought the attention of the committee commit-tee to the provision of the constitution ! which g-overns tiie case, and sueested I that under the constitution they were the j judges ot the qualifications 01 their mem- i bers. Mr. Welling and Mr. O'Xeil both are ' valued and popular members of the hotise, and personal sentiment amone the mem- bers is overwhelmingly against declaring the Is seats vacant. However, there is a feeling among many members that personal per-sonal sentiments should not enter into the matter and that it should be made strictly strict-ly a question of the proper interpretation of constitutional mandates. Yesterday Mr. O'Neil declined to vote, saying that be preferred not to particif pate in that way until the eligibility question ques-tion bad been decided, so inat his voting vot-ing might not possibly invalidate any measure mea-sure under consideration. Mr. Welling voted, but said he hoped the house would expunge his vote from the record should It find him ineligible. Mr. Welling also served notice on the house that unless a decision was reached today he would begin active participation in the debate, which he has refrained from doing so far in the session.
