Ten Drunks Face Judge Muphy u Formal application made yestertho board of county day bufura commissioners for a franchise to the Utah A Idaho Railway company to construct and maintain an electric road up Ogdep canyon. Joseph A. West appeared fur the company, which It controlled by the Ogden Rapid Transit company. According to the petition, the company Intends to build a single track railway, with transmission, telephone snd telegraph lines from the mouth of the canyon to the upper end. For the last month construction work has been done, and temporary tracks are already laid in the canyon from the present end of the car line to a point about 100 feet Into the pass. After considerable argument, the matter was taken under advisement by the board, and will be acted upon la the near future by tho board aa a committee of the whole. Tliere seems to be considerable doubt iu the miuds both of the board snd of the city council, concerning the existence of a definite line near the canyon, separating the city from the county. Buggesilona were made and will undoubtedly be acted upon In the near future, to have the board and city council sit lu extraordinary aes-io- n to determine the exact boundary line between the municipality and the county. Coaunisaioner Wilson advised that the company furnish a survey to the board, showing the exact course to be taken up the canyon. Engineer West agreed to furnish the details. Another serious objection raised by the board gainst the use of the county road up the canyon, waa the poaaible outcome of a suit now pending In the courts between the county and certain property owners to determine the exact width of the roadway. The county holds that it la entitled to 66 feet, while property owners contend that the county holds but twenty feet. As the personnel of the board may be changed within the next sixty days, is was argued this morning,theIt waa presalso deemed Inadvisable by ent board to take immediate and deft' nlte action until the matter waa looked into thoroughly. The petitioning company agrees to widen or reconstruct the county road where necessary, and to aid in keeping it in repair. The matter will be referred to the county attorney.
